Before you Book - Read our Rules and Cancellation Policies

Please NOTE:  The home you are renting is in East Hawai’i on Hawai’i Island aka “The Big Island.”  This is a tropical destination that is subject to storms, creatures (geckos, bugs, rodents etc.), and humidity.  The home belongs to an individual who relies on this income to maintain the home. The home is professionally managed by Salt Water Vacations Hawaii, a division of Salt Water Real Estate, LLC licensed in Hawai’i.  We do not offer refunds for acts of weather, geckos, or bugs inside the home.  To ensure your expectations are met, we recommend you read property reviews, google information about the area, and contact us to answer questions.  Please proceed if you would like to follow our policies and rent this home.  We look forward to seeing you soon!

USE OF PROPERTY: Residential only.  NO PARTIES or GATHERINGS.  The Property is for the sole use as a personal vacation residence for registered occupants.  Guest acknowledges that they will personally occupy the Property for the entire length of stay and will not sublet. Guest shall not use the Property for any illegal or unlawful purpose.

 

1. Quiet hours shall be from 9pm to 8am, during which time the noise from the STVR unit shall not unreasonably disturb adjacent neighbors.

2. Sound that is audible beyond the property boundaries during non-quiet hours shall not be more excessive than would be otherwise associated with the residential area.

3. Guest vehicles shall be parked in the designated onsite parking area or space.

4. The Short Term Vacation Rental shall not be used for commercial purposes.

 

TERMS AND CONDITIONS. 

1.    GUEST: The person placing the reservation must be the same as the credit/debit card holder.  This person is herein referred to as ‘GUEST’.  All other persons involved with the rental are considered to be the Guest’s invitees.  The GUEST is responsible for making the reservation and any changes, cancellation, and damage policies. 

2.   OCCUPANCY: Your reservation must include the actual number of humans who will occupy the property during your stay.  Extra Guest fees may apply.

3.    CREDIT CARD: A valid credit card is required on all reservations regardless of the payment method.  The credit card must have a ‘valid date’ past the date of your stay.

4.    DEPOSIT: A 30% deposit of the total charges is required within 48 hours to confirm the reservation.  The final balance is due 30 days prior to arrival.  Any reservations made within 30 days of arrival are due in full at the time of booking.

5.    

BALANCE: The balance of your payment will be automatically charged to the same payment method used to make the deposit upon 30 days prior to arrival.  To change your payment method, you MUST contact Salt Water Vacations no later than 10 days prior to the date of payment due. 

6.    CANCELLATION POLICY: To offer you the best services possible, we strictly adhere to our cancellation policy. Guest shall inform Agent in writing of Guest’s intention to cancel the reservation. (For reservations made through third parties, additional cancellation policies may apply.) The cancellation policy is as follows:

     a.     If Cancellation notice is received thirty or more days (30+) prior to the check-in date, a cancellation fee of $75.00 will be retained and the balance will be refunded within 7 days from receipt of written cancellation.

     b.    If Cancellation notice is received less than thirty days but at least fifteen days (15-29) prior to the check-in date, fifty percent (50%) of the booking amount of rent and taxes will be forfeited. Half of the rent, tax, security deposit or damage waiver and any pre-collected cleaning fees will be refunded within 7 days from receipt of written cancellation.

     c.     NO REFUNDS if cancelled within 14 days of arrival (0 – 14).  As a courtesy to our Guest, if Agent can rebook any portion of the canceled reservation, Guest will be refunded to the extent that Agent is able to re-book the Property.

     d.    This loss can be avoided if Travel Protection Insurance was purchased and the reason for cancelation is covered under the travel insurance policy. All reservation changes must be acknowledged in writing.

     e.    Owner/Agent Cancellation Policy: In the unlikely event that the Property becomes unavailable for any part of the tenancy for reasons beyond the control of the Agent, including but not limited to the sale of the property, Owner and/or Agent may cancel this Agreement and refund in full to the Guest all payments made. Agent will assist in procuring similar alternative accommodation should this situation arise. Guest agrees that any claims against Owner/Agent arising out of performance or non-performance under this agreement shall be limited to a full refund of all consideration previously tendered by Guest.

7.    REFUND POLICY: Any refunds of rent not covered by the cancellation policy or disputed by Guest must be presented to the Owner of the property by Agent.  Owner has the sole authority to approve or deny refund requests outside of the cancellation policy.  Guest agrees to abide by the refund terms and conditions, if any, set forth by the Owner upon approving a refund which include not posting malicious or inaccurate information online regarding the STVR, Agent, or Owner.  Refunds are processed on the next business day after written approval but may take up to several weeks to appear in Guest account depending on the policies of their banking institution.

8.    DAMAGE POLICY: Your reservation fees include a non-refundable, onetime fee of $45.00 as a ‘damage waiver’ fee.  This fee covers you for ACCIDENTAL damage to the vacation rental home and premises up to $1,500 per reservation.  To enact the waiver for damage occurring during your stay, GUEST MUST:

     a.    CONTACT Salt Water Vacations within 24 hours of the occurrence of or discovery of the damage. Stay@saltwater-hawaii.com

     b.    Salt Water Vacations must determine the damage was accidental and not caused by excessive use or abuse of the property.

     c.     Salt Water Vacations must determine that the registered number of guests was, in fact, the same number of occupants during the reservation.

9.    LOST KEY FEE: Guest will be charged a fee for lost keys up to $150.00.

10. RIGHT TO ENTER: If necessary, Owner or Agent or their designated vendors may enter the property to inspect or make repairs. Owner or Agent will give Guest at least 24 hours minimum notice before entering the Property, and will only enter during reasonable hours except in the case of emergency. Regular vendors to the property including pool, yard, and cleaning services shall be allowed to enter at normally scheduled times.

11. TAXES: The State of Hawaii and Hawai’i County charge General Excise and Transient Accommodations Tax on your stay.  These entities may change the rate of the tax at any time.  You are responsible for any additional taxes for reservations occurring after the change in the tax rate. 

12. INDEMNITY/DISPUTES/JURISDICTION: Guest agrees to indemnify, defend, and hold harmless Owner and Agent from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage, or injury to Guest and guests or their personal property. Owner and agent are not responsible for lost, stolen, or misplaced items. Guest is also aware of the inherent risks to person and property while occupying residences near the ocean or that have pool/Jacuzzi features. Any and disputes arising out of or relating to this contract/agreement, or the breach thereof, which remain unresolved after direct negotiations between the parties, shall first be submitted to non-binding mediation. If any disputes remain unresolved after mediation concludes, the parties agree to submit any such issues to binding arbitration. The parties further agree that the award of the arbitrator is binding upon the parties and that judgment upon the award rendered may be entered in any court of competent jurisdiction. This agreement shall be governed by and construed in accordance with the laws of the State of Hawaii.  All disputes or claims pertaining to the Agreement shall be adjudicated in the State of Hawaii, County of Hawaii. 

13. By confirming this reservation, I warrant that I have read, understand, and agree to all the terms set forth above, including the Occupancy Terms and Cancellation Policy. I agree to abide by the restrictions stated in the House Rules for the property, as well as all terms of this Agreement. I understand that Salt Water Real Estate, LLC is an agent for the owner. I further understand and represent that I will explain the Terms & Conditions to all individuals in my group who are authorized to stay at the property prior to their arrival.

 

Hale Kai Hawai’i Suites Cancellation Policy Addendum

Guest may cancel free of charge up to 14 days prior to arrival.  The guest will be charged 50% of the total price if they cancel in the 14 days before arrival.  All cancellation notices must be received in writing from Guest to stay@saltwater-hawaii.com
